DubLi Network’s Policies and Procedures for all DubLi Business Associates are outlined below. Take your time to read the entire document to fully understand the Policies and Procedures.
I. Business Associate’s Rights and Obligations
A. Ethics
DubLi Network conducts business in an ethical and credible manner and requires its Business Partners to deal ethically with their customers, with each other and with the company. DubLi Network permits no unethical or illegal activity and will intercede when such behaviour may exist. DubLi Network reserves the right to use its best judgement in deciding whether certain Business Associate’s activities are unethical. Furthermore, DubLi Network may use its own discretion in determining the appropriate course of action. If DubLi Network determines that unethical activities may exist, then it reserves the right to suspend or terminate the Business Associate status, including, but not limited to, all commissions and payments of any kind. Under no circumstances would a Business Associate who is terminated for unethical or illegal activity be entitled of a refund of their original application fee, nor are they entitled to sell or transfer their position.
Examples of unethical or illegal activity include, but are not limited to:
1. Making false or misleading representations of any kind including, but not limited to, misrepresentations about DubLi Networks services or the DubLi Network Bonus Plan
2. Cross-line recruiting. DubLi Network Business Associates may not recruit an individual or entity that has been previously sponsored by another Business Associate.
3. Any unauthorized use of DubLi Networks name, trademarks or copyrighted material (i.e. reproducing DubLi Networks forms, business cards, etc.)
4. Violation of any country, federal, state or local laws or regulations
5. Working activities for other Network Marketing companies, which are direct Business competitors of DubLi.
Examples of what our ethics are:
1. Treat others as you wish to be treated.
2. Be honest in all business dealings.
3. Represent DubLi Networks Bonus Plan completely and without exaggeration to all potential Business Associates
4. Work in harmony with all of DubLi Networks Business Associates recognizing that this supports my own business.
II. Marketing and Advertising Policy
A. Use of DubLi Networks Identity
In addition to our Business Associates and employees, DubLi Networks identity is one of its most valuable assets and, therefore, must be protected at all times in order to maintain its integrity for all. As such, DubLi Networks Business Associates are strictly prohibited from representing themselves as having any other affiliation with DubLi Network other than as a “DubLi Network Business Associate” or as an “Independent Agent of DubLi Network” at any time or in any manner.
Also, Business Associates are strictly prohibited from using logos, names, trademarks, or other proprietary information belonging to DubLi Network, its parent company, sister companies or wholly owned subsidiaries.
B. SPAM Policy
Spamming is a crime and will not be tolerated. Violators will not be tolerated, and risk losing their Business Associate status. You will only be warned once!!
C. Development and Use of Business Associate Marketing Materials
DubLi Network, including its parent company, sister companies or wholly owned subsidiaries, strictly prohibits DubLi Network Business Associates from creating, distributing, and/or using unauthorized marketing materials that include any DubLi Network trademarks, logos, names or proprietary information.
DubLi Network will develop such materials with our trademarks, logos and name for the Business Associates.
D. Media Inquiries and Personal Appearances
On occasion, DubLi Networks Business Associates may be contacted by members of the media as a source or subject for a story. If this occurs Business Associates must immediately refer such inquiries directly to DubLi Networks Marketing Department.
Business Associates are strictly prohibited representing DubLi Network in any public media arena and from using uncompensated media forms including, but not limited to, news releases, articles, editorials, unpaid advertising, infomercials/advertorials, and television, cable or radio program appearances to promote or publicise DubLi Network or its products, except as approved in writing by DubLi Network. Such requests must be submitted in writing to DubLi Networks Marketing Department at least 30 days in advance of the media activity. This policy is necessary to ensure an accurate, legal and consistent public image for DubLi Network and its Business Associates.
E. It is strictly prohibited to market any Business Associate or Product Representative packages for a different price to the current and most updated amount that DubLi Network charges.
F. Further Limitations
DubLi Network reserves the right to limit or disallow any marketing activities that cast negative aspersions on the integrity, truthfulness, and/or reputation of DubLi Network.
III. Status as a Business Associate
A. Claims of Employment
Business Associates are independent contractors and not employees of DubLi Network. The position of Business Associates shall not be construed as creating a relationship of employee-employer, agency, partnership or joint venture between any participant, sponsor and DubLi Network. It is impermissible to assert or imply that a Business Associate or prospective Business Associate is or will be employed by DubLi Network.
B. Contractual Obligations
All Business Associates are responsible for any expenses which result from their business operation. Miscellaneous expenses include, but are not limited to, license or permits required to operate a business, legal fees connected with the use of a business name, telephone expenses, product advertising, etc. Business Associates shall not involve DubLi Network in any contractual relationships relative to their businesses. Business cannot and shall not sign contracts, rent or lease office space or equipment, open bank accounts, secure credit, cash negotiable instruments, make purchases or enter into agreements of any kind in the name of DubLi Network. Such action is prohibited and causes the termination of the Business Associate status. Each Business Associate shall hold DubLi Network, its shareholders, partners, members, directors, officers and employees harmless from any claims, damages or liabilities arising out of such action.
C. Reporting Taxes
Business Associates are not considered employees for purposes of the Social Security Act, the Federal Unemployment Tax Act, Federal Income Tax laws or any other laws governing employees. It is the Business Associates responsibility to make self-employment and income tax payments as required by law in the Business Associates own country. As such, DubLi Network does not deduct any taxes from any commission.
IV. Business and Legal Entities as a Business Associate
A. Companies
A sole proprietorship, partnership, Limited Liability Company (LLC) or corporation may become a Business Associate subject to review and approval by DubLi Network. However, no individual may participate in more than one Business Associate position without the prior written approval of DubLi Network.
B. Trusts
Business Associates can operate their representative status in the name of a trust. The person(s) that is (are) responsible for operating the business of the trust must be of legal age and cannot be another Business Associate or have an ownership interest in another Business Associate status.
C. Marriage
A husband and wife may operate under the same representative position or independently.
D. Specifications for Independent Representative Names
DubLi Network reserves the right to approve or disapprove any Business Associate’s choice of business names, formation of partnerships, corporations and trusts.
E. Age
Business Associates must be of the age of majority in the country in which they reside.
V. Identification Numbers
All representatives will be assigned a unique number that identifies them as a Business Associate of DubLi Network. This number is referred to as their Team ID Number. It is the Business Associate’s responsibility to provide this number on all forms and on the Business Associates Agreement when sponsoring a new Business Associate.
VI. Sponsoring New Business Associates
A. Business Associate Agreements
New Business Associates must complete the sign up process on the DubLi Network website at www.dublinetwork.com. The start date of a Business Associate is the date that their completed Business Associate Agreement is entered and the payment is received.
B. Representation
Business Associates shall make no claim or inference to prospective Business Associates as to the anticipated or actual income a Business Associate might earn. DubLi Network makes no guarantees of income, nor assurances of any profits or success. Any success achieved will be based solely upon the Business Associate’s effort, commitment and skills.
Each Business Associate understands that no Attorney General of any state, country or other regulatory authorities ever reviews, endorses or otherwise approves any product membership or compensation program of any marketing company. As such, each Business Associate shall make no such claim to a prospective DubLi Network Business Associate. In the event that a question arises concerning DubLi Network compliance with the law, such question shall be submitted to DubLi Network in writing. DubLi Network Business Associates shall make no false claims or misleading statements concerning these relationships and understand that if they do, their relationship with DubLi Network may be terminated and all commissions and bonuses forfeited.
Business Associates agree to indemnify and hold DubLi Network harmless from all claims, damages and expenses, including attorney fees arising out of actions or conduct in violation of the agreement.
C. Business Associate Disputes
DubLi Network may or may not mediate any disputes between two or more Business Associates if requested to do so by all of the parties involved in the dispute. DubLi Network, however, reserves the right to review sponsoring practices. If DubLi Network agrees to mediate any dispute, its findings shall be binding on all parties involved in the dispute.
D. Changing Sponsorship
DubLi Network believes in and maintains the maximum protection of the Business Associates relationship with his or her sponsor. Therefore, changing sponsors is strictly prohibited.
A Business Associate may join DubLi Network under a new sponsor only after a period of no less than one full calendar year from the date of resignation or no less than one full calendar year after a Business Associate fails to renew. All resignations must be in writing and delivered to DubLi Network.
DubLi Network reserves the right to change sponsorship if it has been found out that unethical or misleading practices were used.
VII. Maintaining/Changing the Status of Your Business
A. Annual Renewal Fee
A renewal fee of €150 is charged beginning one year after the Business Associate start date. The fee is charged to cover the support costs, IT production, annual maintenance and improvements of the Back Office IT system for a period of one year. DubLi Network will automatically subtract the fee from the Business Associates commission if they do not receive a resignation before the period of one year has passed. If the Business Associate has not earned any commission DubLi Network will send an application for the fee. If DubLi Network does not receive the application and renewal fee 30 days after sending the application, DubLi Network will assume that the Business Associate does not wish to renew his/her status with DubLi Network. Therefore deactivation of the position will occur, resulting in the forfeiture of bonuses, commissions or other payments from DubLi Network. It is the Business Associates responsibility to ensure that DubLi Network has his/her accurate and current address information. Renewal applications are available on the DubLi Network website.
B. Selling Your Business Associate Status
To protect the integrity of the business opportunity, DubLi Network restricts the sale of Business Associate status. All requests for the sale of a Business Associate status must be reviewed and approved by DubLi Network. In order to obtain permission to sell your Business Associate status, forward a letter of intention to DubLi Network, indicating your wish to sell. DubLi Network will send all needed documentation to the seller for completion, before the process can begin. The Business Associate status WILL NOT be considered SOLD until it is approved by DubLi Network. Therefore, DO NOT accept any funds from the potential buyer until the sale has been approved and finalized by DubLi Network.
C. Transfer/Disposition of Business Associate Business
Upon the death or incapacity of a Business Associate, or one of its principals, the rights to the commission and marketing position shall pass on to the designated successor IF he complies with all the terms of the DubLi Networks agreement, DubLi Networks Policies and Procedures and fulfils the duties and obligations required of a Business Associate.
D. Cool-off period
A Business Associate may request for cancellation and seek a refund within fifteen (15) days from the date of purchase. The cancelled product must be in re-saleable condition. If the purchases were made through a credit card, the refund will be credited back to the same account.
VIII. Commissions
A. Reports
Hierarchy Reports are available at the DubLi Network website. The Business Associate acknowledges and agrees such information is proprietary and confidential to DubLi Network and is transmitted to the Business Associate in strict confidence. The information provided may not be distributed to any other individual or company.
B. Eligibility for Commissions
All Business Associates must be active and qualified according to the Bonus Plan in order to be eligible to receive any commission.
D. Commissions
Commissions are paid to the Business Associate’s debit card.
IX. Compliance
These Policies and Procedures were created as a guideline for DubLi Network and all Business Associates and serve to protect the rights of both parties. These Policies and Procedures are intended to ensure proper functioning of daily business operations. DubLi Network reserves the right to amend the Polices and Procedures from time to time, as DubLi Network deems necessary. DubLi Network may promptly terminate any Business Associate who violates any provision on the Business Associate agreement, which includes all Policies and Procedures itemized herein. Termination cancels any and all rights, and will be effective upon verification of said violation(s) and notification of the offending Business Associate by DubLi Network. Under no circumstance would a Business Associate who is terminated for unethical activity be entitled to a refund of their original application fee or be allowed to transfer their Business Associate position to another party.
X. AMENDMENTS
In order to sustain a viable marketing company, DubLi Network specifically reserves the right to make any amendments or adjustments it deems necessary with respect to products and services offered, its Policies and Procedures, the marketing and Bonus Plan and/or pricing. Upon notification through the DubLi Network website any changes like that are incorporated as part of this agreement between DubLi Network and its Business Associates.
